Terms and Conditions for Sikkim App Cab

Effective Date: 1st June 2024

The Sikkim App Cab mobile application (“Sikkim App Cab” or the “App”) is operated by the Transport Department, Government of Sikkim (“we,” “us,” or “our”). These Terms and Conditions govern your use of the App and constitute a legally binding agreement between you and the Transport Department, Government of Sikkim. By using Sikkim App Cab, you agree to these Terms and Conditions. If you do not agree with any part of these Terms and Conditions, you may not use our services.

Definitions

Unless otherwise provided, capitalized terms used in these Terms and Conditions shall have the meanings given below.

  • App:The Sikkim App Cab mobile application developed and operated by the Transport Department, Government of Sikkim.
  • User:Any individual who uses or accesses the App, whether as a Customer, Driver, or other user.
  • Customer : The individual who uses the Sikkim App Cab to avail of transportation services.
  • Driver : The individual providing transportation services through the Sikkim App Cab.

Use of the App

1. Eligibility : You must be at least 18 years old to use Sikkim App Cab. By using the App, you represent and warrant that you are at least 18 years old.

2. Registration: To access certain features of the App, you may need to create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Use Restrictions: You agree to use the App only for its intended purposes as described in these Terms and Conditions and in compliance with all applicable laws and regulations.

User Obligations

  2. Compliance with LawsYou agree to comply with all applicable laws and regulations while using Sikkim App Cab. This includes but is not limited to traffic laws, data privacy laws, and regulations related to the use of mobile applications.
  3. Payment: If you are a Customer, you agree to pay the fares and any applicable fees for the transportation services provided through Sikkim App Cab in a timely manner.
  4. KYC Details: In compliance with the Constitution of India and applicable laws, the Transport Department, Government of Sikkim may require you to complete Know Your Customer (KYC) verification. This may include providing government issued identification documents and other information as required by law.
  5. ConductYou agree not to engage in any conduct that could disrupt or interfere with the operation of the App, including but not limited to hacking, unauthorized access, or transmitting harmful code.

Intellectual Property

  1. OwnershipThe App and all intellectual property rights therein are owned by the Transport Department, Government of Sikkim. You agree not to modify, reproduce, distribute, or create derivative works based on the App or its content without prior written consent from the Transport Department, Government of Sikkim.

Limitation of Liability

  1. Disclaimer To the fullest extent permitted by law, the Transport Department, Government of Sikkim disclaims all warranties, express or implied, regarding the App and its services. We do not guarantee the accuracy, reliability, or availability of the App at all times.
  2. Limitation of Liability: The Transport Department, Government of Sikkim shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages.

Changes to Terms and Conditions

1. Modification : The Transport Department, Government of Sikkim reserves the right to modify or update these Terms and Conditions at any time. We will notify you of any material changes by posting the updated Terms and Conditions on our website or within the App. Your continued use of the App after such changes constitutes your acceptance of the revised Terms and Conditions.

Termination

1. TerminationThe Transport Department, Government of Sikkim reserves the right to suspend or terminate your access to the App at any time for any reason, including but not limited to violation of these Terms and Conditions.

Governing Law

1. Jurisdiction These Terms and Conditions are governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles.
